This document constitutes a legally binding agreement between you (“User,” “You,” “Your,” “Entrant”, “Member”, “Participant”) and Optimism Project and Media Group Co., Ltd. (“OPMG,” “we,” “our,” “us”, “Ourselves”), operating as the Wellness + Design Collection (“WDC”).

By accessing, browsing, or using the WDC website at thewdcollection.com, submitting entries to the awards program, making payments, or otherwise engaging with our services (collectively, the “Services”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Privacy Policy. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding agreements. If you are acting on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.

Your usage of Wellness + Design Collection (“WDC”) is subject to terms and conditions defined in this document:

1. You communicate in and understand English, or a third-party translator has translated this agreement to you under oath and with full legal rights to translate legally binding contracts and agreements, in a faithful and fluent way that you understood correctly.
2. You have read and understood this contract, which is in English. You agree to each and every point of this contract, agreement, terms and conditions.
3. You state that you have read the entire Agreement, You understand all the Terms, and You accept all the Conditions.
4. You state that You are lawfully permitted to enter into and form contracts under applicable law. Before you could enter into our Terms and Conditions contract, you must be of legal age and in a reasonable, sound state of mind.

About the WDC Program
The Wellness + Design Collection is an international awards and editorial platform that recognizes excellence at the intersection of wellness hospitality and design. The program includes an awards component, an editorial platform, a directory of recognized properties and professionals, and related media and promotional activities. The designation, structure, and naming of editions are determined by WDC at its sole discretion and may change from cycle to cycle.

Eligibility
The WDC awards program is open to anyone aged 18+ residing anywhere in the world. Eligible entrants include, but are not limited to:

• Wellness hospitality properties, including hotels, resorts, spas, retreat centers, and wellness residences
• Architecture and interior design studios, firms, and individual practitioners whose work falls within the wellness hospitality sector

Entries must represent real, completed projects or properties that are operational at the time of submission. Conceptual or speculative projects are not eligible unless a specific category for such work is announced.

Submission Guidelines
All entries must be submitted online through the WDC website. Each submission must include the required information, images, and supporting materials as outlined on the submission form. It is the Entrant’s responsibility to ensure all information is accurate, complete, and submitted before the applicable deadline.

Image and File Specifications
Images should be high-resolution, a minimum of 1000 pixels on the longest edge, and must not exceed 4MB per file. Supplementary documents, if requested, should be submitted in PDF format. WDC reserves the right to request additional materials or higher-resolution files after submission.

Accuracy and Completeness
You are solely responsible for the accuracy of all information and materials submitted. WDC reserves the right to disqualify any entry that contains false, misleading, or materially incomplete information.

Entry Forms and Submissions
Please note that no entry will be processed unless the entry fee has been received. Work submitted without proper forms and payment will be disqualified. After payment has been made, entries cannot be altered.
Payments are processed through secure third-party payment providers. WDC does not store credit card numbers or sensitive financial data.

Refund Policy
Submission fees are non-refundable once payment has been completed and the entry has been submitted. In the event of a duplicate charge or billing error attributable to WDC, we will issue a refund or credit for the affected amount.

Use and Ownership of Materials
Copyright and all other intellectual property rights in the submitted materials remain with the original rights holder (the Entrant or the credited designer, architect, photographer, or other creator). Submission to the WDC program does not transfer ownership of any intellectual property to WDC. All entrants understand that any image submitted to the competition may be used by WDC for marketing and promotional purposes including in any medium such as exhibitions, print, and digital media directly related to the WDC though there may not be monetary compensation. By placing in the competition and directory, you are agreeing to be included in an editorial publication distributed to media partners, press outlets, and industry publications for editorial coverage and publicity.
All published use of images will include appropriate credit to the photographer and/or design team and/or original rights holder as provided during submission.

Entrant’s Responsibility
You represent and warrant that:

• You are the rightful owner of, or have obtained all necessary permissions and licenses for, all materials submitted, including images, text, and any third-party content
• Your submission does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
• You have obtained consent from all individuals identifiable in submitted images, where required by applicable law

If WDC receives a copyright infringement notice or dispute in relation to your submitted materials, WDC at its sole discretion may decide whether to take down, conceal, delete or un-publish your submitted materials or not, without informing you, without any obligations towards you, without seeking your permission. If WDC decides not to take down, un-publish, conceal or delete your submitted materials, even if such decision is taken by WDC, you will still be legally and fully responsible for any and all costs, damages, fees, fines, charges, penalties and dues that not deleting, not taking down, not un-publishing and not concealing your submitted materials might create, and you are reminded you also promise to protect, indemnify, release, defend, and hold harmless WDC for and from any and all claims, costs and damages, including without limitation all costs, fees, penalties, claims, demands, actions, proceedings, costs, expenses, ancillary charges, auxiliary costs, allegations, assertions, complaints, causes of actions, investigatory costs, loss of profits, intangible losses, loss of goodwill, attorneys’ fees, litigation costs, judgements, suits, costs of any investigation, defenses, settlements, known or unknown, direct or indirect, consequential or non-consequential, incidental or nonincidental, actual, legal, special, punitive, extraordinary, exemplary or any other damages, arising out of or in connection with any and all issues that are related to your submitted materials.

Directory Listing
Members and selected entries may be featured in the WDC online directory, a curated listing of recognized properties and professionals. Directory listings may include the property or project name, location, images, a brief description, professional credits, and a link to the property’s or firm’s website.
Directory inclusion is at the sole discretion of WDC. WDC reserves the right to edit, update, or remove directory listings at any time. If you wish to modify or remove your listing, please contact us at team@thewdcollection.com.
Directory listings are provided for informational and editorial purposes. WDC does not endorse, guarantee, or assume responsibility for the services, quality, or availability of any listed property or professional.

PR, Editorial, and Media Use
A core component of the WDC program is editorial and media promotion. By submitting an entry and participating in the program, you acknowledge and agree that:

• WDC may issue press releases, editorial features, and media communications about selected entries
• WDC may share project-related materials with media partners, journalists, and industry publications for editorial coverage
• Your project name, images, and professional credits may appear in WDC’s newsletters, social media, and partner channels
• Personal contact information (email, phone) will not be shared with media partners without your prior consent

  
  WDC will make reasonable efforts to ensure accuracy in all editorial and media materials. However, WDC does not guarantee specific media coverage, publication placement, or timing of any press activity.

Prohibited Conduct
The user undertakes to:

• not introduce, integrate or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory and/or libelous, vulgar, obscene, damaging to other’s privacy, racist, classist or otherwise objectionable onto the website;
• not upload, post, transmit or distribute content onto the website that may infringe any patent, trademark, trade secret, copyright or other industrial and/or intellectual property rights of third parties (hereinafter, “third party rights”);
• not reproduce, duplicate, copy, sell, resell or exploit for commercial purposes the content of the website or any part thereof;
• not access, alter or delete any information contained on the website that has not been authorized to access.

  
  WDC reserves the right to disqualify entries, suspend accounts, or take other appropriate action in response to any violation of these Terms.

Intellectual Property
The user acknowledges that the website and its content is protected by the laws applicable to intellectual and/or industrial property. The user also acknowledges and agrees that the content reported in advertisements or the information presented to the user by the website or by the advertisers are protected by the rules of copyright, trademarks, patents or other intellectual and/or industrial property rights. Unless expressly authorized by WDC, the user undertakes to not modify or arrange in any way (either free of charge or for payment) and to not distribute, disseminate or create works based entirely or partially on the website or on any media platform. To avoid any doubts, the use of technologies that facilitate the copying of the content of the Software, including, amongst others, spider, spyware or bots is forbidden. All trademarks, logos, trade names and other features of any kind used in the website (hereinafter the “Features”), are owned by WDC, without prejudice to any presence of other signs, logos and trademarks belonging to third parties (including, but not limited to, partners, suppliers and customers) and used by WDC with their permission. The use of the Features by the user, in any manner and for any purpose, including reproduction on other websites, is expressly forbidden, without the prior written permission of WDC.

Privacy Policy
WDC is committed to protecting the confidentiality of the personal data of its users and of all those providing their information to the company in accordance with the privacy policy published on the website under the “Privacy Policy” heading. This policy is provided only for websites operated by WDC and not also for the websites, managed by other companies, which may be consulted by the user via links.

Cookies are used to facilitate navigation within the website, but the user may disable the use of cookies on their browser, however, ease of browsing will be reduced. For further information and for the instructions to disable the use of cookies.

User’s Right
The personal data subjects have the right at any time to obtain confirmation of the existence or otherwise of such data and to know its content and origin, verify its accuracy or request its integration or updating, or correction. Pursuant to this Article, the user shall have the right to request cancellation, anonymization or blocking of data processed in violation of the law, and to oppose its processing in any case, for legitimate reasons.

Modification of these terms
WDC reserves the right to modify these Terms and Conditions of Use without prior notice. The changes will be effective as and when they are published on the website. Following modifications of these Terms and Conditions of Use, the user must accept them in order to continue using the website. WDC recommends viewing this page regularly to ensure correct understanding of the Terms and Conditions of Use.

Applicable Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation, either party may submit the dispute to binding arbitration administered under the rules of the Thailand Arbitration Center (THAC), with the arbitration to take place in Bangkok, Thailand. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm.

These Terms and Conditions, together with the Privacy Policy and any other policies or guidelines published on the WDC website, constitute the entire agreement between you and WDC with respect to the Services and supersede all prior or contemporaneous communications, proposals, or agreements, whether oral or written. WDC in compliance with the regulations concerning the processing of personal data, undertakes to preserve the IP number used by the User to access publication or consultation functions of the content.
